MessageClaw — Terms of Service

Last updated: August 2026

Effective date: August 2026  ·  Jurisdiction: Australia  ·  Please read these terms carefully. By creating an account or using MessageClaw you agree to be bound by them.

1. Acceptance of Terms

By accessing or using the MessageClaw service (the “Service”), including our website, web portal, and mobile application, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

2. Description of Services

MessageClaw provides a secure messaging-management platform that includes the following features:

3. User Responsibilities

You agree to:

You are responsible for all activity that occurs under your account.

4. Privacy

Our handling of your data is described in the Privacy Policy, which forms part of these Terms. In particular, MessageClaw operates a zero-persistence architecture for message content: SMS messages, contacts, and calendar data are read on your device, encrypted end-to-end, and never stored on our servers.

5. Intellectual Property

MessageClaw and its licensors retain all right, title, and interest in and to the Service, including all software, trademarks, logos, and related intellectual property. You retain ownership of the content and data you provide to the Service. The Service is provided under a source-available-for-audit model and is not open source; you may not copy, modify, or redistribute the Service except as expressly permitted in writing.

6. Limitation of Liability

To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. MessageClaw shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the Service. To the extent liability is not excluded by law, our aggregate liability shall not exceed the total fees you have paid for the Service in the twelve (12) months preceding the claim.

7. Termination

You may terminate your account at any time through the Service. We may suspend or terminate your access to the Service if you breach these Terms or if we are required to do so by law. Upon termination, we will delete your account data in accordance with our data-retention commitments, generally within 30 days. Message content is never stored server-side and is therefore not affected by account termination.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New South Wales, Australia, without regard to its conflict-of-law principles. The Service is operated from Australia and all data is stored in Australian data centres. Subject to any consumer protections that cannot be excluded, you agree to submit to the exclusive jurisdiction of the courts of New South Wales, Australia for any dispute arising out of these Terms.
